Pushor Mitchell Partners Obtain $1.8 Million Judgement In ICBC Trial

Pushor Mitchell Partners Paul Mitchell K.C. and Bryan Fitzpatrick completed a trial last October 2022, and the trial judge Madame Justice Lisa Warren has awarded the client $1,793,000 in total damages, plus court costs.  

The case involved an accident in Kelowna where a Licensed Practical Nurse student sustained permanent injuries to her back. The trial judge awarded $220,000 in non-pecuniary damages, and over $1,547,000 in past and future income loss.

ICBC made submissions at the trial that the client should have only received $75,000, and that her disc herniation and subsequent surgeries were not caused by the crash. The trial judge agreed with our submissions that the accident did indeed cause her present symptoms.
