The Canadian Intellectual Property Office (CIPO) is increasing most of its official fees by 25%s, effective January 1st, 2024, to address its “current structural deficit situation and return the organization to a position of financial sustainability”. CIPO is fully funded through its own service and filing fees, which have not been substantively reviewed or adjusted since 2004.
For example, for an Application for the Registration of a Trademark in Canada, the fees in 2023 vs. 2024 are as follows:
If submitted online, fees for the first class of goods or services to which the application relates:
2023 fee: $347.35 vs. 2024 fee: $458.00
For each additional class of goods or services to which the application relates:
2023 fee: $105.26 vs. 2024 fee: $139.00
As a result of the fee increases and to avoid paying these increased fees, we recommend that intellectual property owners affected by these changes consider taking certain actions prior to this year’s end. We are advising clients to process their applications sooner, rather than later, , in order to avoid paying these increased rates.
